A vote of no confidence in the Prime Minister brought by the Riigikogu will be prepared as a resolution of the Riigikogu, which is published in the Riigi Teataja. The President of the Riigikogu notifies the President of the Republic about the vote of no confidence in the Government of the Republic or the Prime Minister in writing no later than the next day after the vote of no confidence.

If a vote of no confidence is brought in the Government of the Republic as a whole or the Prime Minister, the government will resign. 

Once the government has resigned, the President of the Republic must designate a candidate for the Prime Minister within 14 days. The candidate for the Prime Minister will submit a report on the bases for the formation of the forthcoming government to the Riigikogu within 14 days after which the Riigikogu decides on authorising the candidate for the Prime Minister to form a government by open vote without negotiations.

The candidate for the Prime Minister who has been authorised by the Riigikogu to form a government will submit the membership of the government to the President of the Republic within seven days. The government will be appointed to office by the President of the Republic within three days.

The President of the Republic will release the Government of the Republic from office upon appointing a new government.

The resigned Government of the Republic will continue its activities until a new government assumes office. The resigned Government of the Republic must avoid making any decisions of principle or decisions which increase expenditure of the state budget, unless it is strictly necessary.
